Training a neural network to learn concepts like "shiny" and "round" by doing statistics on millions of examples of them in order to generate novel art is not remotely comparable to theft. I don't think he has a great case for saying he owns this one he just prompted with midjourney, but in general, this argument is obsolete. It wasn't a tool before but it is now. Most people making AI art aren't even prompting anymore, they're using controlnets, latent coupling, IPadapters etc. which completely changes it from a drunk genie that does everything for you but misses an arm to something with more precision and intent than a brush. You control things like poses, composition, lighting, textures, depth etc. in a very reliable way across multiple dimensions. Still less effort than creating it with a brush, but effort is a poor metric to measure value. It's less effort to machine a centrifugal pump with a 5 axis CNC than it is to carve one out of wood with a blunt knife, but that doesn't make it prettier or more useful or a productive use of anyone's time.
