It's clearly the fault of whoever loaded the truck. I have to ask: what the fuck is the truck carrying? Dynamite? A self-driving car would go the speed limit, and if it hit the load it would be able to both brake as hard as possible and deploy airbags. I don't think it would be likely to kill the driver.
