I think you are thinking about this the right way. But I want to correct you in that the black box does NOT give judgements. Judges do not press the "black box button" and automatically have to issue sentencing based on the result. This is merely an extra bit of information that a judge can use to aid in sentencing... AFTER the criminal is convicted of the crime. In the end we are STILL putting our faith in the judge.
But again, I agree that the real question is, does the algorithm typically present a good indicator of recidivism or not. I sincerely doubt they claim that they are always perfect, or that judges should do what they say, no exceptions.
