They did once sue the AI companies, a group of artists did demanding compensation or removal from training data. BUT it was dismissed because the judge said nobody could actually prove that their art was used unless they looked through the training data and proved it was there.
The only one who has that training data list is the AI companies, and they aren't exactly gonna give that up willingly so that was a dead end.
