You're correct in your initial assessment, but I think you're incorrect in your last. The algorithm does not predict or force "justice". It does NOT dictate a judge's sentence, or if the person is guilty of a crime or not. It merely reports it's best guess for the likelihood of recidivism. By your reasoning (if I'm correctly understanding your meaning that is), it could _"at best only accurately"_ determine the chance for recidivism _"as it has been done."_ There is no recidivism _"as it should be."_ It is guessing possible futures based on historical data, plain and simple. It is STILL the responsibility of the judge to set a sentence... mind you, for someone who has already been convicted of the crime.
