I suspect the car and driver are legally at fault just the same as if the car was not a self-driving vehicle. As for the driver probably not being able to see the victim soon enough to stop in time had the driver been watching the road, well that is still the fault of the driver for not driving within the range of her/his (I can't tell what the driver is) headlights.
