The current version of FSD beta is fully capable of level 3. I can confirm this because I have had zero interventions since receiving the latest FSD Update.
Gradual rollout of level 3 is coming in the next few months or so subject to regulatory approval. The difference is just removal of the "nag feature" which requires the driver to demonstrate that they are ready to take over at a moments notice. Thus removal of this requirement constitutes level 3 because the driver will no longer be required to continuously monitor.
Since Tesla has millions of FSD vehicles on the road, and is the only driving automation system that operates in all locations and conditions, it won't take very long to move on to level 4 and 5.
