It's more of a fair use claim. These companies are training off of artists with the understanding that those models shouldn't be competing with those artists, because that is the most important section of fair use. It doesn't matter how transformative it is if it heavily competes with the original. These companies are turning around and using those models to compete with those very artists by offering the same service but at a fraction of the price, which is only possible because they trained from those artists for free. What these Ai companies are doing is socializing the personal costs of learning art while privatizing all of the profits to some tech bro that knows nothing about art. And who sometimes even actively insults those very artists
