It was an intelligent comment, and perhaps even clever, but neither represent enlightenment, which will be the future criteria for rights (and current humans do not rate it yet, since they are still Universally Clueless). As for having 'robots' that can make moral decisions, we need them since the more enlightened minds you have, the better our odds of survival in a harsh and deadly universe. So an enlightened classification system will not be human/robot, but enlightened/not-enlightened. Read my Philosophy of Universal Survival and Morality, for the Space Age, no less. It is a response to Continued Universal Human Cluelessness, and it offers Final Enlightenment - for all minds, whether biological-based or artificial.
