For real, it's a clear misunderstanding of the field of statistics. Though, the interesting question is how do we know which criminals who have committed less than 4 will commit more than 4? After all, this is supposed to be an algorithm to predict (not just detect) recidivism, pointing at something that's clearly already recidivism isn't what it's supposed to do.
