Eh. Yes and no? Ur right they don't use skin color, a lot use landmarks on the face determined by light. The issue is that darker ppl don't reflect as well. It does get many non-black ppl wrong but just based on how color and light in general works its not gonna read us as well. There is a different type of facial recognition that doesn't use light. I cant remember what its called but it like recreates ur face by turning it black and white and recreates landmarks through essentially digitally putting the ping pong ball things u see in old motion capture suits. Doing it this way is just exponentially more expensive. Like to the point its unreasonable to expect most police departments to be able to afford one. Especially since as far as I know they are mostly made for face rigs for motion capture and aren't great at capturing at a distance.
So it does work worse for black ppl but its not really racist. It's just the cheapest/only affordable version of it that tends not to work as well due to the way it works.
