Programs like Photoshop are full of your juicy stuff which you describe earlier and yet authorship of paintings made in these programs doesn't go to companies like Adobe but to you as an artist. So yes, authorship of AI-generated art can be simply attributed to the humans who own these AI systems. To your second statement, I can only say, computers can be creative. Like it or not, creativity is just a process, not a human prerogative. And computers are very very good at processes. People just don't get this yet, but it is as it is and you can't ignore this fact. Just because the law doesn't reflect this new situation yet, this doesn't mean that these AI systems are doing something unethical or illegal. Artists too are using copyrighted material, never asking for permission to use it and they don't even bother to mention this fact in their works. Why? Because we simply call this fact an inspiration, which is very vague term. But for example in the science world, you have to cite everything because if you don't you are a thief. Why art don't act as science does? Everybody is standing on the shoulders of giants but people simply forgetting this fact because of their selfishness. Anyway, history is somehow repeating itself. In the early days of photography, many artists became jobless because they were no longer needed to paint portraits. Do you know how artists cope with this new situation? They invented new styles like impressionism and surprisingly painting human portraits didn't die either and now photography itself is considered an art. AI will never replace humans because it will never possess human qualities. AI is a new thing, when it will help to cure cancer it's a good thing, and when it's gonna replace not-so-worthy artists it's a bad thing. But you have to take it as a whole package, anyway, we don't have any other choice. So in conclusion artists hold nothing in a legal case against AI-generated images. Seriously nothing. They will be pulverized. This is how I see it despite your whole complexity, nuances, legal and ethical consideration which you mention earlier.
