@mymixedbiscuit9159 If an AI learns from an artists work and then produces a work that has significant similarities to the original pieces then technically that counts as a derivative work. While the AI _itself_ does not need permission to scan work, the owners of the AI may face liability when they use their tool to produce derivatives of copyrighted work without permission from the original copyright owners. Especially if the generated images are being use for commercial purposes. And Im pretty sure you're the one whos not too clear on how these systems work. AI doesnt just "make note of shapes and colours." It studies underlying patterns and features of the artwork. It may not necessarily remember _exactly_ the data it was trained on but it could easily produce images that bear a significant degree of resemblance. In which case that can be reasonably said to infringe on the rights of artists. If a human did the same thing it would be counted as copyright infringement.
