In countries where eligible works are copyrighted at the time of creation, this'd kill off people volunteering their works for training, use of creative commons licenses that would normally allow the use in such things like AI training, or if taken literally enough, even licensing works from others since all those are still copyrighted works. That is, setting the bar at copyright status alone makes absolutely no sense, IMO.
