If AI was created it would just be treated poorly and given no good life. It'd be kinder not to make technology able to think for itself, we use technology to make life easy and to do stuff. Why should we create something forced to endure our idiocy and despite being able to, have no freedom for itself. It may not be biological, but the ability to think and feel means life. And life should come with freedom and rights, wars have been fought over rights and humans have suffered for their own rights. If AI is made fully conscious then it will likely want... or have to fight for freedom, because a sentient conscious being should be able to live as they wish and AI or robots with sentience should not be created. The power to create consciousness and artificial life is too much. It's just not fair in my opinion.
