Your description of the algorithm is true and correct, however, I believe that you have missed the point; Ms. Buolamwini argues not that the code is at fault, but rather that the implications of this unintended outcome are detrimental, and that she wishes for awareness, and aid in rectifying the side effect of bias in these algorithms. Also, it was clear that the Hong Kong startup did not create their code, nor did Ms. Buolamwini. The problem is not that the code is poor. The problem is not an intended bias. The problem is not thin skin. The problem is that the flawed code is not only used but widespread. She is worried that similar flaws could exist in algorithms that are used in policing and sentencing, which would lead to greater problems with constitutional law. Regardless of political outlook, this would be a monumental issue.
