Regarding legality. Since you mentioned Instagram, their ToS: "When you share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with our Service, you hereby grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). " The above means that Instagram can share your artwork posted with companies like Stability Ai for training, or for use in training their own models (e.g. Meta). It does suggest that "private" uploads can be excluded from that, however, LAION did not scrape "private" data as that would be a willful disregard for cybersecurity measures (i.e. hacking), which is illegal. Other sites have similar clauses in their ToS. I'm not arguing the ethics of such a clause, but you unfortunately have no legal ground to stand on by posting your work to Instagram.
