This is a super easy one - when a researcher paid for access to the data, then uses that data, it is to further their field that will lead to improvements.
In OpenAI’s case, their “researcher” didn’t pay for access, didn’t do so to further the field, and instead used the data to build a new method for accessing the original data. Equivalent to me inventing a new internet to bypass paywalls and allow access to data - all you have to do is pay me instead.
Simple. NYT is in the right. OpenAI is in the wrong. Plain and simple.
