It's not an opt out system.
Websites TOC's are required to cover you opting to allow them to redistribute images you upload to their website. (this allows them the legal right to show the image on their website) these are rights you give THE WEBSITE COMPANY as you are the legal owner of the image and it's copyright, and you are granting the website company your permission to redistribute the image in line with the conditions laid out in the TOC. Conditions which may allow the website company to sell access to your art for AI training.
HOWEVER!!! When DA tried this, it resulted in a MASSIVE drop in users, and they were forced to change it from opt out to opt in. But most AI companies aren't even doing this, and are being challenged for scraping the input training data ILLEGALLY.
