The reason for a federal ban has more to do with how complex the law could become, which would hinder new companies from entering the market.
For example, the age verification laws on adult content. More states are voting for this which forces companies that are notoriously awful at handling user data to fix it. So companies either spend a ton of money to ensure they meet regulations, both US and EU, on handling government documents or just stop providing service within those areas.
Since AI can be used for this purpose, then AI companies could be subjected to these laws as well. Which means only large companies with close government ties like Microsoft and Amazon can continue as normal, and smaller companies are forced eat those costs.
