Not any different than humans training themselves on the art of others, and making their own art. As soon as a human makes and sells art too similar to previously copyrighted artwork, they can be sued. If an ai user does the same, it is no different.
And as soon as the training model is completely based on licensed or copyright free art, will artists be happy? It's not going to change anything. But sure, let's get the training data cleared up.
