only issue I see with this specific case is and I'm not sure if this is factual but he had his foot ON the gas? overriding the autopilot? specifically disabling autopilot's ability to brake the car? Tesla should have automatic braking for collisions yes, but a car should also go forward when you hit the forward control.
I can already see the headline "Tesla swerves and brake checks 30 people on the highway while the driver was hitting the gas pedal to quickly avoid another tesla that hit the brakes to avoid ANOTHER TESLA hitting the brakes?! BUT NONE OF THEM HAVE PHYSICAL BRAKES!?!" THAT is what yall expect TESLA to do?! REMOVE the ability to hit the gas in your car? sure it should have more warnings but legally they can't really make the warnings anymore apparent without breaking more rules! Tesla did nothing wrong here the driver held the gas, and looked away and ignored warnings he has had MULTIPLE TIMES TO LEARN including the car stopping itself in the past for the same behavior. Tesla should still implement a 911 call if someone gets more than one warning like this to make sure they aren't having a stroke at the very least. I don't like tesla I will never own a tesla but be reasonable with what you expect of tesla when the laws and rules YOUR country votes for; are convoluted. I'm no expert but a human tool should NEVER take the control away from the human when the human tries to use it, the device should require licensing if it poses a danger. this car didn't kill someone by itself, if the driver was not in the car holding the gas pedal the car "in theory" would've stopped. The car would've stopped much MUCH sooner since it already had 90% of it's warnings go off already during that drive, all of which got veto'd BECAUSE HIS FOOT WAS ON THE GAS PEDAL COME ON PEOPLE. everything else I've heard about the company is probably valid, but THIS one is beyond the pale unreasonable to even question tesla for! You can hurt someone with a candle by leaving it burning next to a sack of flower and a fan that you're actively aiming at the flower to dry it causing the room to explode (exaggerating you'd have to light the candle after the flower spreads but point stands) WOULD YOU HOLD THE FAN AT FAULT? THE FLOWER AT FAULT? THE CANDLE AT FAULT? NO. NO. NO you would not! The person who LIT The candle, and the one who DRIED the flower by blowing air on it are at fault of the explosion not the fan maker, not the flower maker, not the candle maker the user of the device who ignored reasonable safety concerns. accidentally or on purpose doesn't matter to me.
