OpenAI just needs to reference the controversy with Musk's Grok. It was clearly publicly decided that AI output was the product, and responsibility, of the AI/company and not the source materials "owner". If the punishments are the Ai's/companies then so are the rewards.
The true problem lies with either ruling on this subject. Both options would send the current Ai market into chaos. If they rule the output is *not* original or unique then suddenly that puts the makers of the content the Ai was trained on liable for what Ai spits out, because it is "just" a reproduction of their work, no matter what form it took. If it is ruled the other way, Ai crashes and a huge sector of the economy vanishes overnight.
Either ruling would be unprecedented chaos. I anticipate this case to be settled so that a ruling is never reached. Leaving the question, at least officially, unanswered.
