You are missing an important part. The AI is not creating images from a dataset, as the data set is only used for training. It is learning from the dataset. Only in the absence of learning does if fall back to memorization or pattern blending that resembles copies. Poor training does raise copywrite issues. One example is that water marks and signatures tend to be excluded from copywrite checking software and they use that in training to force the AI to learn rather than make copies. So the AI just copies watermarks and such as it learns they are part of the art that is very common to the art and doesn't get flagged. If people can view your work online then they learn from it. The AI isn't making copies of it when training is done properly, rather it is playing games to learn from it. Make the original from noise then make something similar that doesn't get flagged by copywrite software.
