I like to see the ethics behind AI art by the labour relations involved. There is labour involved in those creating what eventually becomes training data. There is labour involved in developing an AI model. And the output of the system reflects all that labour. And, if workers are entitled to the results of their labour, then the artists and AI developers collectively are entitled to the results of the system.
The question then is how these two sides of the moat coordinate their entitlement to the output, and how well they agree on how to manifest that entitlement. For instance, if involved artists and model developers agree to make the output CC-BY-NC-SA.
Of course a more Marxian analysis like this might not be very appropriate for a more immaterial topic like art. But I think it's a fair analogy through the lens of labour, because much of the frustration some artists have with AI art is the devaluing of their labour due to the use and abuse of AI art systems with comparable results, akin to artisans when cloth became trivial to weave in the Industrial Revolution.
