The video is a bit misleading. In Thaler's case, the art is created 100% with AI with no human creative input. That's why it can't be copyrighted (who gets the copyright?). But nowadays AI art has a certain degree of human input (the prompt), which makes the art generated potentially copyrightable by the prompter (depend on how much creative input is put into it)
