Open Source is chosen by the programmers behind the code/program, and is essentially saying "You can use this without paying me or crediting me". I don't really see a moral issue in it when the creator of the program is saying to do so. The most popular thing to do this is Linux, which is an open source operating system.
There are lots of things to critique about AI art, but I want to be sure we're critiquing the correct points.
