I agree with the sentiment, but unfortunately using "existing data" aka art has been "legally" used in many cases (or hovering in a grey area in others) in so many other fields and applications, generally as long as some changes have been made, that this problem is both old and far more wide reaching than most realize. The whole hip-hop genre essentially grew out of sampling other people's work. In certain vfx industries, compositors often taken existing work, modify them and get away with it. I remember the minority report show had one vfx artist literally use Mass Effect concept art as part of a larger matte painting. Few notice these things, where as with AI art its a lot more overt, thus it sticks more in the public consciousness.
If something were to be done, it should hit every possible industry, not just AI art itself, otherwise it has to be something we accept especially as technology changes and disrupts our perception of things.
