I think, purely legaly thinking, not moraly, if the AI can be used to reproduce articles verbatim, it is copyright infringement. If the AI providers make that behavior impossible even through what they call "prompt hacking", then training the AI with publicaly available sources would likely be ok.
As of now, big AI models do not only reproduce articles of newspapers, they even reproduce whole books verbatim. That was tested on all major AI models, and none managed to stop that entirely, although some were better than others.
