In my opinion, this isnt primarily a problem of facial recognition software, but a problem of a failing justice system.
A facial recognition alone could never be the only evidence to charge, let alone convict someone.
If you have no further evidence, motive, means etc, it should be a dead end lead. This happens already for a long time in the US, long before facial recognition software even existed.
