If something is recognizable as someone else's work, whether it's a human forger or an AI, it's still illegal. You can't sell an exact, or nearly exact, copy of another's work (like that example of the photo of the Afghan girl). Of course, you can be Roy Lichtenstein and make (almost) exact copies of comic book panels and sell those copies for millions. Or that one guy who sold an inkjet print of a web site (Suicide Girls), including copyrighted content, for something like $20,000. The controversy only adds value to the work. The core of the problem is, you can make a subpar copy of another artist's work, or work in that artist's style, and there will still people who will buy it, whether it's done by hand or by AI. AI just makes it easier.
