It’s called federal preemption it's already used in quite a few regulations. The Constitution lets the federal government override state laws or block them in certain areas to keep rules consistent nationwide. In this case, it would have stopped states from passing AI laws for 10 years not banned laws altogether. It doesn't matter anyways 99 out of 100 votes in the senate struck it down in favor of state rights.
