First number one rule, KEEP RECORDS OF YOUR PROCESS. So that in court you can show what was AI generated and what was human created. Keep that in mind, generated vs created. Using Rick Ruban's Creative Act, he outlines 4 stages in the creative process 1) collect 2) experiment 3) craft 4) complete. If you use AI in the first or second stage you will be fine, but you must transform the output from the AI collect and/or experiment phases during the craft and complete stages. And document what was AI generated vs what you added and transformed during the entire creative process, so you can prove your work in court.
The example of the human image with a prompt to use AI that generated the final output, would then reverse these 4 stages. The human artist created the 1) collect idea and 2) experiment to create the line drawing and the prompt but then used AI to 3) craft and 4) finish the image. Again, document your creative work process.
