The legal industry isn't afraid of AI hallucinating, they are afraid of losing their monopoly. When over 90% of people can't afford a lawyer, AI becomes the only way for average americans to exercise their 1st Amendment right to petition the government. Trying to regulate this technology under UPL is absurd. AI isn't a person giving advice,, it's a tool. If a pro se litigant files a bad motion, you blame the litigant, not the AI,, just like you don't blame a typewriter for a bad book.
If courts are so worried about fake case law, the solution isn't hidden standing orders that unrepresented people will never read. The solution is proactive, the clerk should hand every pro se filer a packet warning them about Rule 11 sanctions for submitting AI hallucinations. Put them on notice. I use AI to enhance my litigation, which has led to successful federal filings and dismissed camera tickets. The courts should be thrilled that tools exist to help people actually understand civil procedure, rather than dealing with more sovereign citizen nonsense. Stop trying to ban a tool just to protect the attorney paywall.
