I do think there should be some sort of limitation to what you can feed an AI with, from a legal standpoint. That if your AI can generate content, you can therefore not simply take all the content of an artist, train the AI on all that content, and then generate competing content ... unless you got permission to do it.
It's completely different from a human taking inspiration. This is getting closer to the point of tracing. There's also been thoughts about the existence of fake signatures on some generated art.
