Where would your argument be, though, if we started making models fully trained on 100% royalty free images, or artists that actually start selling their material to be trained on? You wuld still wish to complain about AI slop (and perhaps rightfully so) , but this argument that AI art if theft is a very loose and ultimately worthless avenue to go down. If someone showed you an image generated in midjourney based on style references on the midjourney creator's own legit art work, you would struggle to remotely make an argument it's theft. You wouldn't be able to cite precisely which artists' work were being copyright infringed. Using the catch-all claim that, well, the model was trained on all these copyrighted works, so therefore it's some weird fruit of the poisonous tree thing rendering everything made by it theft is such a bad argument to make.
