I think the major difference between how visual artists and musicians are treated is that musicians have backing from powerful companies that will lose a lot of money. And we have seen that industry fight in court time after time after time over IP abuses. To my knowledge, visual artists have no such backing and haven’t built up a comparable body of law. However, this may change because of the abuses discussed here. For example, in my mind, the intentional uploading and reuse of Sam’s artwork is a clear copyright violation. But I don’t know that there is case law on point to address this. There is for music. It may be the case that visual artists need to come together as a group to leverage their collective power, and create a new economic model that allows for choice and compensation as AI continues to grow in this space.
