The fair use argument is a misdirection. How can you possibly argue that taking someone's copyrighted work and using it as training data for a computer algorithm was in anyone's mind when they were determining the boundaries of fair use? And analogizing machine learning to human learning is another misdirection, because even if the underlying mechanism was proven scientifically, philosophically, or mathematically to work on the same principles, there is an obvious difference in magnitude if not kind, and society recognizes something can be bad in one context and not another. What these arguments are really doing are dismissing and hand-waving the very real ethical and societal concerns people have with the labor of artists being used to enrich and empower techno-oligarchs by relying on the confusion and lack of clarity caused by rapid technological advancement and society's inability to keep pace.
