Thank you for succinctly pointing out the problem. I actually love AI and AI generated art. I think it's an amazing technology. But it's an issue when the success of these AI *relies on* existing artwork. At that point, these datasets that can produce certain results are quite literally violating copyright. I think a lot of people fail to realize that "fair use" isn't a blanket stealing card. There are various factors, which includes but is not limited to: how transformative it is (THE AI MODEL, NOT THE ARTWORK GENERATED FROM IT), if it is a commercial product, and if it competes in the same market as the original work. So I do think we can have free-use AIs. I also think we can have a world where people can opt-in to submit their work to AIs with appropriate attribution. But there also need to be an ability for people to opt-in in the first place, and there needs to be acceptance of licensing for works used in AI, even if it means paying royalties or fees to the original artists. The most unfortunate thing is that I think we already have the legal right to DMCA or otherwise take down these models. But it would take a mountain of effort, time, and money to litigate such things. So even if the law is in our favor, it is unrealistic to actually fight against it with our current laws. The laws need to change, mainly to actually punish people that abuse copyright, and it needs to have the context of the size of the creator at hand.
