The part you're missing is that they tried training the AI on non-copyrighted art and it was terrible. It was only when they expanded the program to use all art - copyrighted or not copyrighted - that the program progressed to a level they thought would take them about 10 to 20 years to achieve, seemingly overnight.
They're not going back on that kind of progress. They have also grabbed the attention of some of the richest and most powerful people in the world who are now all in with their support. So, unfortunately, you're just gonna have to eat this one.
