I think the second one is a bit different. Obviously if an artist takes inspiration or references it might look similar but somewhere in it there’s still their own style or creativity. Where as AI it’s only based on other peoples work, It’s like if I get starry night and edit that one painting by evard munch onto it. Sure technically it’s a new thing but it’s not original or creative at all
