Reminds me an argument that black people were not oppressed, because there was some black slave owners/traders. Moot point. "AI/Robots will never be in state where rights should be extended to them" is essentialist argument implying that "humanity" is something essential trait instead of complex combination of cognitive abilities. BTW, racists of the past was also operating essentialistic view of races, where non-white people were considered essentialy worse than white people. And AI being used as instrument of oppression preventing it from receiving civil rights is unsound unless you also argue that any human (e.g. billionaires) who oppress other humans should be stripped of their civil rights. And saying that discussion about AI oppression should not exist in world where humans are oppressed is similar to critics of feminism who say, "why aren't you going to middle east where women have much worse than here in west". It's not either or situation. You can be advocating for human, animal and AI rights at the same time. One doesn't exclude another.
