The only way this kind of technology can be constrained to follow principles of due process is if laws are passed to ensure that the technology is designed to monitor and track its own use/misuse - and that this record is automatically accessible to public scrutiny. Put simply, if we need watchmen, we need a system for watching the watchmen. Technically, it's possible - what's needed is the political will to make it law.
