In essence, it is a fair use and rights problem in the field of art with the presence of a new technology called AI. How AI Art is commercialized today is definitely not ethical and is not out of good faith for reasons such as: 1. companies using data or artworks which the artists did not consent to 2. some people using this technology to mimic others or proclaim themselves as conventional artists when what they are doing isn't art but as AI art prompters or AI art curators AI Art today is commonly associated with artworks that mimics visual styles that are similar to existing artists produced by an AI model, but it used to be a unique form of expression by certain few modern artists who developed their own models and trained with datasets curated by their own, for example Refik Anadol. This is one of the reason why I think AI Art is here to stay as it brings out a new form of artistic expression and how it is used can be a form of art itself which I personally find very exciting. AI Art in the commercial world is still new and the law needs time to catch up, to be frank, the law is still struggling to keep up with general online fair use. I hope one day we can see AI and art to have a more collaborative relationship than what it is right now.
