For a proper painting or photograph to exist it does require you to train and learn through millions of examples captured by your eyes and to get really good result it requires you to train, over and over ... Like AI.
So you are mistaken thinking that photography and painting is born in a vacuum without a precursor of both copyrighted and non copyrighted images.
