The relevant argument here isn't whether AI training is free use or not. The relevant argument here is that AI training does not violate copyright because it does not reproduce the copyrighted works. If I read a journalists news article, and then paraphrase the entire thing, that isn't a violation of copyright. AI is simply doing a version of that. AI training consists of ingesting all of the copyrighted works, and then spitting out unique responses based on that training on copyrighted works. No different than if I read Harry Potter and then give a synopsis of the book. If the AI service WAS spitting out word-for-word copies of works, then yes, those individual instances would be violations of copyright, but that's the overwhelming minority of cases.
