I'm against deepfake porn, 100%. I just don't think it is a simple as working out how to enforce laws but what is and isn't covered. We need to keep in mind that no matter how hurtful or how many dipshits believe whatever they see on the Internet Deepfakes are just animations. Yes very good animations indistinguishable largely from reality but they are animations nonetheless.
Just figuring out what constitutes porn in a country with free expression and speech is a nightmare. What everyone seems to gloss over is deepfakes are not the actual person but third party creation of that person. It is just a very high fidelity 3D model. Yes, it draws from images around the Internet, but a human artist does that too it is just more labor intensive and, depending on the program, less automated.
My questions though are where is the line? How much fidelity does it require to move from a 3D animation model to a Deepfake? If I do it in unreal engine 5 it's legal but if I do it on DeepBrain it is illegal? What if it is only face being animated as the target with a body that had differences? What about blended images?
Where is the line between 'porn' and 'satire'? Before deepfakes lookalike porn was a thing, will deepfaked porn of a consenting lookalike be covered? Are there any exceptions for satire or political speech? For example: is a meme clip of Putin screwing Trump doggy considered porn?
What about rule 34 fan art? What if a creator says that isn't Scarlett Johansson, its Black Widow? Or that isn't Jane Jones, it is just the fictional character Jan Slone I created that happens to look quite a bit like Jane Jones but there are differences; look see that mole, see how the ears are a bit different, eye shade isn't quite the same blue. Does Taylor Swift have that birthmark on her inner thigh? If not then it clearly isn't her. What if the face isn't shown, like a mask or from behind angle but the voice is deepfaked 'oh, harder, faster baby...'?
That is aside from how you are going to enforce International laws across boarders in the age of VPNs and differing nations' cyber privacy security laws. Just judging from the amount of Last of Us Elle and Anime of young characters porn done in Unreal Engine across the Internet they can't enforce child pornography laws now. Someone in the segment said in effect, just because you can't enforce it doesn't mean you shouldn't try. Yes it does; having unenforceable laws degrades the rule of law and encourages contempt for the law. If a law can be out and out ignored by violators then why have any respect for the law in general?
