There's no more issue with AI training on a copyrighted work than there is with other authors learning from and being inspired by copyrighted works. Copyright applies to outputs, to content -- their degree of similarity to existing works. It doesn't say you can't learn from something, regardless of whether you're human or an AI model. That's fair use. The issue in this lawsuit is how the works were obtained.
