The argument about photography and painting by the AI bros ignore an important fact. Both photography and painting coexist relatively peacefully as the to be excellent at either requires skill and genuine talent to create inspiring art. Many great photographers started out as painters. While, as photographer, I might be inspired by a photographer or painting, when I go out to take photo of something I have to make many artistic decisions on site and in the moment to get a shot even if the effort was inspired by another's work. I'm interpreting the scene based on my sensibilities not copying another's work. A painter will do the same. AI is never creating a new image based on what is immediately in front of the eye or lens but by regurgitating the results of images (mostly photographs) by others. That is not art but crass theft of real intellectual property and work of real artists. The fundamental issue is whether art requires someone's creative decisions based on the technical nature of the specific genre to produce a work or can something regurgitating bits from the works of others be considered art. I'm in the former camp; art requires someone's personal creative decisions before you can it art.
