This question is meaningless, by the time the government gets around to considering these laws.
We'll already have them for cyborgs and for people who chose to upload themselves or if a family member paid for an ai version of you based on the information that's available.
They'll also be smarter then us, if some aren't already, so the justifications they come up with and the solutions will sound fair to us. At least 2/3 will be as easily manipulated to the idea of rights to anything, as they are by Derren Brown but maybe it'll end well.
